IRES or not?

An interesting observation if indeed an IRES is present in the 5' UTR. However, no data is presented on the integrity of bicistronic mRNA so the possibility exists that the observed IRES activity is in fact just splicing of the construct. This would also apply to the 5'UTR-Ring1B construct where splicing would remove 5'UTR and make the mRNA more efficiently translated due to processing, and probably deposition of a EJC proteins.
